1. ELIGIBILITY AND QUALIFICATION REQUIREMENTS

The bidders must meet the following minimum qualifying criteria:-
- Bidder’s annual financial turnover in the same name and style during any one of the last three financial years should not be less than 60 % of the estimated value of the Contract.
In the event of merger or acquisition causing changes in the name of the bidder during the last 3 years such bidder shall also arrange to submit the financial turnover in the old name as well as present Group Company (overseas or domestic).
- The bidder, in the same name & style, should be in business at least for five years at the time of bid opening. In case of change of name of the bidder by merger/acquisitions/change in status, the bidder may be eligible based on the documentary evidence.
- The bidder should have valid registration under various Acts that may be applicable for the contract proposed. This shall include but not limited to Income Tax, Companies, Excise Duty, Sales Tax, Works Contract Tax, Service Tax, Employee State Insurance, Contract Labour, Provident Fund etc.
- The bidder, during the last five (5) years ending last day of the month previous to the month in which bid is opened must have successfully designed, supplied, installed and commissioned either of the following :
- One contract / work of similar nature costing not less than 80% of the estimated value of the contract.
OR
- Two contracts / works of similar nature each costing not less than 50% of the estimated value of the contract.
All the bidders must submit a copy of the completion certificate along with copy of the purchase order/contract/agreement towards proof of their eligibility and qualification requirements.
Where the works are executed for a private company, the bidder/s, in support of their eligibility should submit a copy of the relevant TDS Certificate (Tax Deducted at Source) received from their clients for the works. Such copy of TDS certificates issued in the name of the earlier company from whom the business was transferred shall be acceptable. Further, bidders should also submit copy of Income Tax Returns for the three previous in original or certified true copies for income tax purpose.
- Bidder/s shall furnish a certified copy of the Annual Report for the previous completed three years (audited Balance Sheet and Profit & Loss Account) along with their PAN and Service Tax Registration number and Solvency certificate for at least 20% of the estimated cost of the work in the financial year in which bid is being opened.
In the event of merger and acquisition causing change in the name of the bidder, the copies of the balance sheets of the previous completed three years (audited Balance Sheet and Profit & Loss Account) of earlier Company whose business was transferred to the new Company shall be furnished.

Interested bidders can purchase the bidding documents either in person or by mail on a written request along with a non-refundable tender fee as specified above.
Each bidding document may be purchased by any interested eligible bidder in person on payment of non-refundable tender fee by demand draft (amount as indicated above) between 14.00 hours and 16.00 hours on any working day (Monday to Friday) except public holidays. The tender document can also be sent by mail with an additional amount of Rs.250/- towards inland Courier charges. The crossed demand draft shall be in favour of National Dairy Development Board, payable at Mumbai. Tender fee by cash or cheque is not acceptable. NDDB shall not be responsible for any delay in receipt of the bidding document, sent by Mail.
3. Downloading the Document
(a) The bid documents will also be available in the website at http://www.nddb.org and can be downloaded and used as tender documents for submitting the offer. Separate remittance specified above shall have to be enclosed in the form of crossed demand draft, drawn in favour of National Dairy Development Board, payable at Mumbai, towards non-refundable cost of the tender documents. This is in addition to the earnest money and should be separately enclosed with the offer, on or before the due date for submission, otherwise the offer will be treated as invalid.
(b) It is hereby brought to the notice of all bidders that if any change/additions/deletions/alterations are found to be made by them in the tender and the same is subsequently noticed at any stage, even after award of the contract, the bidders are liable for all consequences thereof and NDDB shall be free to take suitable action as deemed necessary.
4) Submission of bid
The bidders, who purchase the bidding document, are eligible for submission of bids in their names only.
5) Bid Security/Earnest Money Deposit (EMD)
All bids must be accompanied by bid security (EMD) and the same should be in the form specified in the bidding document.
The Earnest Money Deposit should be submitted along with the bid .
Bids not accompanied with EMD, shall be summarily rejected.
6) Opening of Bids
All the bidders should submit their bids in sealed cover. All the bids shall be opened in the presence of Bidder’s representatives on the date specified above.
7) Rights Reserved by NDDB
National Dairy Development Board does not bind itself to accept the lowest bid. NDDB reserves the right to award the job either in part or full. NDDB at its sole discretion and without assigning any reason thereof, also reserves the right to accept any/or reject any or all bids.
