• Upon completing the registration process, you are alone responsible for maintaining the confidentiality of the password and account, and are fully accountable for all activities that arise under your password or account. You ensure that you should logout from your account at the end of each session.

• Under no circumstances will NDDB be liable in any way for any material content, including, but not limited to, for any errors or omissions in any data, or for any loss or damage of any kind incurred as a result of the use of any data posted, emailed, transmitted or otherwise made available on its website.

• NDDB does not warrant that the website or tendering facility will be error-free or will meet any particular kind of criteria of accuracy or reliability of information

• You agree to not use NDDB’s website or name to:

• upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, defamatory or otherwise objectionable;
• impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

• Any unauthorized reproduction, publication, distribution or public exhibition of the data provided on the website, in whole or in part, is strictly prohibited.

• You agree to comply with all applicable laws regarding the transmission of data from NDDB’s website.

• You agree to indemnify and save harmless NDDB and its subsidiaries, affiliates, officers, agents and employees, from any claim(s) or demand, including reasonable lawyers fees, made by any third party due to or arising out of the data/information you submit/transmit or make available through the tendering facility, your use of the tendering facility, your violation of the terms and conditions, or your violation of any rights of another individual or entity.

• You agree not to reproduce, duplicate, sell, trade, or utilize for any commercial purposes, whole or any portion of the tender document.

• NDDB reserves its right to modify or discontinue, temporarily or permanently, the tendering facility with or without notice. You agree that NDDB shall not be liable to you or to any third party for any alteration, deferment or discontinuance of the tendering facility.

• Where any dates or times need to be calculated relating to submission of tenders, the Indian Standard Time shall be used.

• You agree that NDDB may, under certain circumstances and without prior notice, immediately terminate your account, and access to tendering facility . Cause for such termination shall include, but not be limited to:
  • breach of the terms and conditions;
  • requests by law enforcement agencies or other government agencies;
  • a request by you (self-initiated);
  • discontinuance or material modification to the tender document (or any part thereof);
  • unexpected technical or security issues or problems;
  • you have engaged in fraudulent or illegal activities.
  • NDDB may provide, links to other websites or resources. As NDDB has no control over such sites and resources, you acknowledge and agree that NDDB is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, or any other materials on or available from such websites or resources. You further acknowledge and agree that NDDB shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such website or resource.

• You specifically understand and agree that NDDB shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, or other insubstantial losses, resulting from accessing the tendering facility and/or any other matter relating to the tender.

• You agree that, except as otherwise specifically provided in terms and conditions, there shall be no third party beneficiaries to this Agreement.

• The terms and conditions comprise the entire agreement between you and NDDB and govern your use of the tendering facility. You also may be subject to additional terms and conditions that may apply when your tender is processed.

• We give no warranty and make no representation, whether express or implied, that any files, downloads, applications available via this website are free from viruses, or any other data or code, which may likely or has the ability to corrupt or affect the operation of your computer, database, information system or any other network.

The above terms and conditions are governed by and to be interpreted in accordance with appropriate Indian laws, rules and regulations for the time being in force. In the event of any dispute arising in relation to these terms and conditions or any dispute arising in relation to this website including the tender facility, whether in contract or tort or otherwise the courts at Anand, Gujarat, India will have exclusive jurisdiction to adjudicate upon that dispute.
